Temporary and/or Permanent Visas for Foreigners

​These procedures allow foreigners to live and work in Mexico under specific conditions and must be managed through the National Institute of Migration (INM) to ensure the legality of their stay in the country. They include various types of permits, such as FM3 and FM2 visas.

Temporary Visas (FM3): These visas are granted to foreigners who wish to reside in Mexico for a limited period, generally from one to four years, and may be renewable. There are different categories (business, research, students, work).

Permanent Visas (FM2): These visas are for foreigners who wish to reside in Mexico indefinitely. They can also be renewable and are available for various circumstances (business, research, students).

Marriage Permits

These immigration procedures aim to ensure that foreigners comply with the obligations and regulations set by the INM, allowing them to adapt to personal or work-related changes during their stay in the country. Correct and timely submission is crucial to maintaining immigration regularity in Mexico and avoiding potential penalties.

 

- Marriage Permit: If a foreigner wishes to marry in Mexico, they may need to obtain a marriage permit from the INM, depending on their immigration status and the civil status of their partner.
 

Entries

Entries: This procedure refers to entry into Mexican territory, which may involve requesting specific permits depending on the purpose of the visit (work, tourism, studies, etc.). Foreigners must present identification documents, visas, and, in some cases, invitation letters or employment contracts. This is processed with the INM at entry points (airports, borders), and in some cases, pre-authorization of a visa from the Mexican consulate in the country of origin may be required (e.g., visa for job offer).

Notifications

- Change of Address Notification: Foreign residents in Mexico are required to notify the INM of any change of address within 90 days of the change.

- Change of Civil Status Notification: If a foreigner changes their civil status (e.g., marries or divorces) while residing in Mexico, they must notify the INM.

- Change of Activity Notification: If a foreigner with a specific permit changes their activity in Mexico (e.g., from student to worker), they must notify the INM and, in many cases, request a change in their residency status.

Employment Termination of Foreign Workers

Employment Termination of Foreign Workers: When a foreign worker ends their employment in Mexico, whether by resignation, dismissal, or contract termination, the employer must notify the INM to update the worker’s immigration status. Depending on the circumstances, the worker may need to change their residency status or leave the country.

Immigrant Declarations

Immigrant Declarations: This procedure grants a foreigner permanent resident status definitively in Mexico. This is the final stage for foreigners who have resided in Mexico under a temporary residency status and wish to obtain permanent residency without the need to renew their residency permit.

Mexican Nationality Certificate

Mexican Nationality Certificate: Issued to Mexicans by birth who are considered nationals by another country and who wish to take on a position or function requiring Mexican nationality by birth and who do not acquire another nationality.

Naturalization Letters

Naturalization Letters: These are legal documents certifying the acquisition of Mexican nationality by foreigners and are issued under various modalities. These include naturalization by residence, which requires a stay of at least five years in Mexico; being a descendant of a Mexican or having Mexican children; being from a Latin American or Iberian country; making notable contributions in various fields, which requires only two years of residence; marriage to a Mexican citizen, where two years of cohabitation must be proven; and being under parental authority or adopted by Mexicans, requiring one year of uninterrupted residence.
